General Terms & Conditions – Myrch Fest (Mirchi Group B.V.)

Event: Myrch Fest, 9 August 2026, The Hague (hereinafter: the “Event”)
Article 1 – Definitions
In these General Terms & Conditions, the following definitions apply:
- Organiser: Mirchi Group B.V.
- Event: Myrch Fest, including all activities, facilities, build-up and breakdown moments and related components on or around the location.
- Location/Site: the event site designated by the Organiser (Zuiderpark) in The Hague.
- Visitor: any person who attends or wishes to attend the Event.
- Ticket: the (digital) admission ticket for the Event.
- Ticket Provider: the third party facilitating ticket sales, payments and/or distribution (e.g., Celebratix).
- Supplier/Exhibitor (Vendor/Standholder): any party offering goods or services, renting stand space or otherwise participating in the Event as a supplier.
- House Rules: additional rules/instructions of the Organiser or Location communicated via the website, signage, communications, or on-site.
- Force Majeure: any circumstance beyond the Organiser’s reasonable control, including (but not limited to) pandemics, government measures, terrorist threats, fire, strikes, extreme weather conditions, security incidents, cancellation/illness of artist(s), technical failures, or a decision by competent authorities to cancel.
Article 2 – Applicability
2.1 These General Terms & Conditions apply to all Visitors, participants, Suppliers and other parties involved in the Event.
2.2 By purchasing a Ticket, entering the Site, or participating in the Event, the person concerned accepts these General Terms & Conditions and the House Rules.
2.3 If the Location applies additional terms, those apply in addition. In case of conflict, the strictest safety rules prevail.
Article 3 – Tickets, purchase and right of withdrawal
3.1 Tickets are generally sold and processed via a Ticket Provider. The Ticket Provider may apply its own terms regarding payment, distribution and service fees. The Organiser is not responsible for the content of those terms.
3.2 The Organiser is not liable for malfunctions, errors or defects in (the systems of) the Ticket Provider, payment providers or ticket distribution, except where mandatory law provides otherwise.
3.3 No right of withdrawal: Tickets are not subject to a right of withdrawal, as they concern a leisure service provided on a specific date.
Article 4 – Admission, age and identification
4.1 Admission is only possible with a valid Ticket. The Organiser may check ticket validity and investigate suspected ticket fraud.
4.2 Tickets are generally personal. Only the first person who presents and/or has the Ticket scanned will be granted entry. The Organiser may assume that this person is the rightful holder.
4.3 The Visitor is responsible for safe storage of Ticket data, QR codes and/or wristbands. Loss or theft does not entitle the Visitor to replacement or refund.
4.4 Age: the Event is accessible only to persons aged 18 and over.
4.5 The Organiser may (randomly or if in doubt) request a valid ID. If refused, admission may be denied or the Visitor may be removed without any right to refund.
Article 5 – House rules, order and instructions
5.1 Visitors must behave respectfully and orderly at all times. Discrimination, intimidation, violence, threats, unwanted behaviour or disturbance of public order will not be tolerated.
5.2 Visitors must immediately follow instructions from the Organiser, security, first aid, bar staff and other (emergency) services.
5.3 The Organiser reserves the right to refuse entry to or remove persons who misbehave, are under the influence, or violate these terms/house rules, without any right to refund.
Article 6 – Safety, health and checks
6.1 Visitors must comply with all safety and health regulations, including any measures imposed by the government, municipality or Organiser.
6.2 It is prohibited to bring dangerous objects. This includes, among others, weapons, explosives, fireworks and other items posing a safety risk.
6.3 The Organiser may search Visitors and luggage (or have them searched/checked) at entry and during the Event. Refusal may result in denial of entry or removal without refund.
Article 7 – Prohibited items and substances
7.1 It is prohibited to bring, possess or use (including but not limited to) the following items on the Site or during the Event:
- weapons, imitation weapons and dangerous objects (incl. spray cans/CS gas),
- explosives, fireworks, flares/torches,
- drugs (substances listed in Schedules I and II of the Dutch Opium Act),
- nitrous oxide (cartridges/cylinders) and related accessories,
- own (alcoholic) beverages, glassware and cans,
- professional photo/film/audio recording equipment, drones (unless permitted in writing),
- food items,
- animals (except assistance dogs if permitted by the Location and agreed in advance),
- selfie sticks extended longer than 1.5 meters or other constructions that may cause danger.
7.2 The Organiser may confiscate prohibited or dangerous items. Confiscated items will not be returned.
7.3 In case of violation, the Organiser may refuse entry, remove the Visitor and/or hand the Visitor over to the police, without refund.
Article 8 – CCTV and photo/video
8.1 CCTV may be present on and around the Site for safety, supervision and incident registration.
8.2 Visitors may take photos and videos for personal use. Commercial use or professional recording (incl. drones) is only allowed with prior written consent from the Organiser.
8.3 By entering the Site, the Visitor grants permission to be photographed/filmed and for such material to be used by or on behalf of the Organiser for promotional and informational purposes (online/offline), without any right to compensation.
Article 9 – Alcohol, drugs and refusal
9.1 Alcohol is served only in accordance with applicable laws and only to persons aged 18 and over.
9.2 Excessive alcohol consumption, use/possession/dealing in drugs, or visibly being under the influence may lead to denial of entry or removal without refund.
Article 10 – Sales, promotion and commercial activities
10.1 Unauthorised sales, promotional activities, sampling, handing out flyers, or distributing promotional materials are prohibited without written permission from the Organiser.
10.2 The Organiser may revoke permission, for example due to complaints, nuisance, safety considerations, or conflict with the Event’s image/brand.
Article 11 – Programme, line-up and changes
11.1 The Organiser may change the programme, line-up, timetables, site layout and/or facilities.
11.2 Programme changes do not entitle the Visitor to a refund.
Article 12 – Force majeure, cancellation, rescheduling
12.1 In case of Force Majeure, the Organiser may cancel, interrupt, end early, reschedule to another date and/or location, or implement changes reasonably necessary.
12.2 In case of rescheduling, the Ticket will in principle remain valid for the new date/location.
12.3 In case of cancellation due to Force Majeure, the Organiser will determine an appropriate arrangement.
12.4 The Organiser will announce changes/cancellation via its chosen communication channels (website, social media, email via ticket provider, etc.).
Article 13 – Cashless payment and balances
13.1 The Organiser may use an open-loop and/or closed-loop payment system (debit/credit card and/or tokens/balance).
13.2 Remaining tokens and/or unused balances will not be refunded after the Event and will lose validity.
Article 14 – Standholders/third parties on site
14.1 Third parties may offer products and services at the Event (e.g., food, drinks, merchandise, attractions).
14.2 The Organiser is not a party to agreements between Visitors and such third parties and is not liable for damage arising from third-party products/services.
14.3 The Visitor indemnifies the Organiser against claims arising from disputes between the Visitor and third parties.
Article 15 – Liability (visitors)
15.1 Entering and staying on the Site is at the Visitor’s own risk.
15.2 The Organiser is not liable for direct/indirect damages, consequential damages, loss of profit or non-material damage.
15.3 The Organiser is not liable for loss, theft or damage to property.
Article 16 – Privacy and personal data (GDPR)
16.1 The Organiser processes personal data in accordance with the GDPR, including for ticket control, safety, CCTV, communication and marketing.
16.2 Further information on processing, legal bases, retention periods and data subject rights is included in the Organiser’s privacy statement and is available upon request.
16.3 CCTV footage and incident reports may be shared with competent authorities where necessary.
Article 17 – Final provisions
24.1 Dutch law applies to these General Terms & Conditions.
24.2 Disputes will be submitted to the competent court in The Hague.
24.3 The Organiser may declare House Rules, technical instructions and supplier guidelines additionally applicable. These form an integral part of these General Terms & Conditions.
24.4 If any provision is null and void or voidable, the remaining provisions remain fully in force; the parties will replace the affected provision with one that approximates the purpose and intent as closely as possible.
